PayByLInk Terms of Use

PayByLink Service (“Service”) allows clients to make payment via a secure link delivered in a text or email rather than making payment in a showroom. The terms and conditions for use of the Service for the purchase of products are detailed below and should be read carefully. Watches of Switzerland (“we” or “us”) may vary these terms from time to time and therefore you should check them before you make a new purchase.

Please note, any use of the Service or purchase made through the Service constitutes an agreement to abide by the terms and conditions detailed below which shall override any other terms and conditions.


Contact Details

Our primary method of communication with you is by email. Therefore, please ensure the email address you provide us with is correct.In the unlikely event of a problem with your email, we will contact you by telephone. Again, please ensure the contact telephone numbers you provide are accurate.

Should you be unable to contact your local showroom, you may send us notices or communicate with us by email to info@watchesofswitzerland.com. When you send an e-mail to us, you are communicating with us electronically, and you agree that we may communicate with you electronically. You acknowledge that that communications by email are not considered confidential communications. Therefore, please do not send us any confidential information by email.


Orders

Order acceptance and the completion of the contract between you and us will take place on the dispatch of the products ordered unless we have notified you that we do not accept your order. Non-acceptance of an order may be a result of one of the following:

  • The product you ordered being unavailable from stock
  • Our inability to obtain authorization for your payment
  • The identification of a pricing or product description error
  • You not meeting the eligibility to order criteria set out in these Terms & Conditions
  • Your order not passing our verification checks.

We cannot accept orders from persons under the age of 18.


Delivery Address and Estimated Delivery Times

All deliveries will be made to you at the addresses specified by you during the selling process. You will be responsible for the products as soon as they are delivered. Ownership of the products shall pass to you once we have delivered them to the address shown on the order.

Please note, if you requested your order to be delivered to an address different than the billing address used to pay, we will need to verify your connection to that address.

Our standard delivery service is provided by secure shipping services and you will normally receive your order within 3 working days from dispatch, excluding public holidays. We deliver Monday to Saturday between the hours of 8:00 a.m. to 6:00 p.m. All deliveries will require adult signature upon receipt. Tracking information will be provided via email or text at the time of dispatch.

Whilst we endeavor to delivery your item on time, in exceptional circumstances such as adverse weather, severe road network issues, pandemics or any circumstances beyond our reasonable control, we may experience delays. We politely point out that in such circumstances, we do not take responsibility for any impact such delays may have.

We do not ship to P.O. Boxes addresses. We ship only to U.S. Continental addresses.


Lost Packages

Even though packages are sent via secure courier, on rare occasions we do experience losses whilst in transit. Please get in touch immediately with the showroom with which you placed your order if you think this may be the case with your order.

Please be aware that if we are not contacted within 5 days of the expected date of delivery, an insurance claim cannot be made, and you will be unable to claim any loss from us.


Payment

We will connect to your payment card company for authorization when you submit your payment details via the PayByLink Payment Page.

We take care to ensure that your order and any potential subsequent transactions are conducted in a secure environment. If products are not available for any reason after we have accepted your order, we will let you know. We will not charge you for these products and will refund any amounts already paid (if any(.

Goods will not be dispatched until payment collection has been successful.


Validation Checks

All payment methods are subject to validation checks and authorization by the payment service provider. If the payment service provider refuses to authorize payment to us, we will not be liable for any delay or non-delivery.

In addition, any validation checks performed by our Client Service Team that fail may result in order cancellation, which will be communicated to you.

Enabling 3-D secure on your credit or debit card will most certainly ensure that your transaction passes all our validation checks. 3-D Secure is designed to be an additional security layer for your remote credit and debit card transactions. 3-D Secure is referred to differently depending on the type of card you carry: SecureCode (Mastercard), Verfied by Visa (Visa), SafeKey (Amex) ProtectBuy (Discover). It is simple to activate via your online credit card account or by contacting the phone number on the back of your card.


Returns

Refunds for timepieces can be requested within 10 days of the date of dispatch or pick up and within 30 days for all other purchases.

Please note, orders can only be refunded once received back to our location it was sent from, provided items are in new, unworn condition, no scratches / markings, not sized or adjusted. This includes all warranty cards, instruction booklets and in original packaging.

Unfortunately, we cannot accept returns of Special Orders or items that have been engraved, personalized, or altered.

All refunds must be credited in the same tender used for the original purchase except for cash transactions, which will be refunded by wire transfer or corporate check.

Please Note: When processing your return, we may need to speak with you before we are able to complete the process. If we are unable to contact you within 14 days of receiving your item\(s\), we will return it to the delivery address linked to the order.

Watches of Switzerland is the owner of the copyright of all digital material provided by us including content, design, text, graphics, and photographs.


Disclaimers

We make no warranties of any kind, whether express or implied, in relation to the Service, including but not limited to, implied warranties of satisfactory quality, fitness for a particular purpose, non-infringement, compatibility, security, accuracy, condition or completeness, or any implied warranty arising from course of dealing or usage or trade. Likewise, we make no warranty that the Service will meet your requirements or will be uninterrupted, timely, secure, or error-free.

We will not be liable for any economic losses (including without limitation loss of revenues, profits, contracts, business or anticipated savings) or any loss of goodwill or reputation, or any loss or corruption of data, or any special or indirect or consequential losses arising out of your use of the Service; in any case whether or not such losses were within the contemplation of us at the date on which the event giving rise to the loss occurred. This includes but is not limited to any injury caused by any computer system, phone line, hardware, software, or program malfunctions, or any other errors, failures or delays in computer transmissions or network connections.

YOU SHALL NOT USE THE SERVICE FOR ANY ILLEGAL PURPOSES, AND YOU WILL USE IT IN COMPLIANCE WITH ALL APPLICABLE LAWS AND REGULATIONS. You agree to be fully responsible for (and fully indemnify us against) all claims, liability, damages, losses, costs and expenses, including legal fees, arising out of your use of the Service, or the use by any other person accessing the Service using your device or account.

As set forth in our privacy policy, you acknowledge that we cannot guarantee, and therefore shall not be in any way responsible for, the security or privacy of the Service and any information provided to or taken from the Service by you. Choice of Law, Binding Arbitration Clause

These terms will be interpreted in accordance with the laws of the State of New York and the United States of America, without regard to its conflict-of-law provisions.

By using the Service you agree that, except as otherwise specified herein, the laws of the State of New York without regard to principles of conflict of laws, will govern any dispute of any sort that might arise between us or any of our affiliates regarding your use of the Service.
